How can someone be a judge, and yet be so STUPID???

A judge in Massachusetts on Friday ruled against a lawsuit that questioned the state’s ban on assault weapons and large-capacity magazines, declaring that the weapons were not protected by the Second Amendment.

Assault weapons are considered to be military firearms, U.S. District Judge William Young said in his ruling, therefore disqualifying them from being included in a citizen’s right to “bear arms.”

Policy makers, rather than the courts, were better suited to decide on the regulation for the weapons, he said.

“Other states are equally free to leave them unregulated and available to their law-abiding citizens,” Young said in his ruling. “These policy matters are simply not of constitutional moment. Americans are not afraid of bumptious, raucous and robust debate about these matters. We call it democracy.”

The lawsuit was filed against state Attorney General Maura Healey last year by the Gun Owners’ Action League of Massachusetts, among other parties, who claimed that AR-15s couldn’t be considered a “military weapon” because of their inability to shoot in fully automatic mode. They also claimed the ban infringed on Second Amendment rights.

That notion was ruled out, however, as the judge pointed out that the design of semi-automatic AR-15’s is based on guns “that were first manufactured for military purposes” and that the AR-15 is “common and well-known in the military.”

“The AR-15 and its analogs, along with large capacity magazines, are simply not weapons within the original meaning of the individual constitutional right to ‘bear arms,'” Young said.

The decision was championed by Healey, who said the judge’s decision “vindicates the right of the people of Massachusetts to protect themselves from these weapons of war and my office’s efforts to enforce the law.”

Does this judge really believe the U.S. Navy SEALs, Marine Recon, Army Rangers, etc. all carry AR-15s?

  1. If you think lawyers are stupid and politicians are corrupt, take a look at their illegitimate offspring the judges. They’re arrogance doesn’t match Obama’s but it comes close. Their ignorance is on display every time they make proclamations like this. Their honesty and integrity are on parade when other judges do not commit judges like this to St Elizabeth’s.

    If you think cockroaches are disgusting try imagining your child marrying a judge.

  2. A ban on „assault weapons“ is akin to the proverbial camel in the tent. Once it’s in you can’t get it out again.
    ANYTHING one can use to attack (assault) someone is an „assault weapon“ – even a sharpened pencil. Such legislation leaves far too much leeway for interpretation in future trials – especially if the first judgement included the reasoning that one criteria for banning a specific rifle is the fact that it is „common and well-known in the military“. This reasoning facilitates the ban of almost any weapon on the market. Take a good bolt action rifle. Chances are it is pretty similar to a Remington 700 which is the grandfather of common sniper rifles throughout many military forces worldwide. It is thus „common and well-known in the military“.
    Almost ANY pistol or revolver with just a bit of history falls into the same category.
    No Sir, this judge isn’t stupid at all. He knows how to apply psychology and uses catchphrases and trigger words masterfully.
    Take a test in weapon psychology yourself and think of the catchphrase „tactical“.
    Think of any rifle (even a small .22lr). Change its stock, add a couple of picatinny rails to it, screw a flash hider on its muzzle and paint the whole thing black.
    Now you‘ve got a badass tacticool rifle others will call an „assault weapon“!

    This is one of my rifles. It’s a .22lr ISSC „Advanced Tactical Ultimate“, lol.
    Not so funny is the fact that until now EVERYONE who saw that rifle seriously asked me if I had a permit for it and was shaking his head whenever I told him that no permit was required. All of them would gladly vote to ban such a rifle I am sure.
    Over here in Europe our societies are terribly narrow minded when it comes to weapons. Don’t let that happen to you. Your freedom depends on the right to bear arms.

      I’m calling him stupid because the Constitution states that U.S. citizens have the right to own EXACTLY those types of weapons. If a hillbilly in North Georgia can figure that out, then I’m sure this judge can. It’s the right to KEEP and BEAR ARMS…not just hunting rifles, but the EXACT same arms as the military, or better. His decision is wrong, and doesn’t really make any sense. The Bill of Rights clearly states that the right was pre-existing, so it is GOD given and a natural right of mankind…and that government cannot infringe upon it. That means NO small, incremental encroachment in any way. He should know that.

      1. There should be an uproar of all Americans so that this judge understands he was wrong.
        Since all that matter is being blacked out over here in Europe, I can’t know if this already is happening.
